Acceptance of Terms

By accessing or using Backup Buddy's products, services, or website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use our services.

Services Provided

Backup Buddy provides data backup and recovery solutions. We reserve the right to modify, suspend, or discontinue any part of our services at any time with or without notice.

User Responsibilities

• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

• Lawful Use: You agree to use our services only for lawful purposes and in compliance with all applicable Australian laws, including the Privacy Act 1988 (Cth) and the Australian Consumer Law as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

• Prohibited Actions: You must not attempt to reverse-engineer, hack, or interfere with the functionality of our services.

Payment and Subscriptions

• Fees: Some services may require payment. All fees are non-refundable unless stated otherwise in our Return and Refund Policy or required by Australian Consumer Law.

• Billing: Subscriptions are billed in advance and automatically renew unless canceled. You may cancel your subscription at any time through your account settings.

• Consumer Guarantees: Under Australian Consumer Law, our services come with guarantees that cannot be excluded, including that services will be provided with due care and skill and within a reasonable time.

Intellectual Property

All content, trademarks, and materials provided by Backup Buddy are owned by or licensed to us. You may not reproduce, distribute, or modify any content without prior written consent.

Limitation of Liability

To the extent permitted by law, Backup Buddy is not liable for any indirect, incidental, or consequential damages arising from the use of our services. We do not guarantee uninterrupted or error-free service. Nothing in these Terms excludes or limits your rights under Australian Consumer Law.

Termination

We may suspend or terminate your access to our services if you breach these Terms or engage in activities that harm our platform or other users.

Changes to Terms

We may update these Terms at our discretion. We will notify you of significant changes via email or our website. Continued use of our services after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
